A court of the Northern District of Texas granted a general agent's motion to dismiss a reinsurer's claims for specific performance, breach of contract, and fraud, holding that the claims for specific performance and breach of contract relied upon terms not contemplated within the contract itself and that the claims for fraud sought damages duplicative of damages under the breach of contract claim, thus barring relief under the economic loss rule.
