A court of the Northern District of Texas accepted a magistrates recommendation to remand a storm damage dispute, finding that the commissioner of insurance is both the statutory and contractually-appointed agent for service of the defendant surplus lines insurer and that the notice of removal was filed more than 30 days after service.
