A court of the Eastern District of Texas granted in part an insurer's motion for summary judgment, dismissing common law bad faith and fraud claims where the insured conceded those claims, but denying summary judgment as to the insured's Insurance Code claims, holding that Chapter 541 claims do not depend upon common law bad faith claims and that evidence did not establish a bona fide dispute as a matter of law.
