Court: ED Tx  05/31/2023  Life Insurance Policy Held to Be Separate Property

A court of the Eastern District of Texas made an Erie guess and resolved competing motions for summary judgment between alleged beneficiaries in an interpleader action regarding life insurance benefits, holding that the policy at issue was the decedent insured's separate property and that a provision of the Texas Family Code voiding certain beneficiary designations following divorce does not apply where the insurance policy is separate property of the decedent and was issued prior to the marriage.
