A court of the Western District of Texas followed its own precedent in holding that an insurer's Chapter 542A.006 election of an individual representative's liability in state court on the day of removal was proper and justified denial of the insured's motion to remand and the granting of the insurer's motion to dismiss without prejudice claims against the non-diverse individual representative.
