The court found that the alleged beneficiary failed to adhere to the timelines and requirements of the Local Rules regarding briefing of motions, but nevertheless the insurer did not establish that the alleged beneficiary lacked standing to assert her claims and only dismissed the alleged beneficiary's breach of contract claim, the assertion of which violated an earlier order of the court.
