A court of the Western District of Texas accepted a magistrate's recommendation to remand an action alleging commercial property damage, finding that a non-diverse broker had not been improperly joined where the insured pleaded that the broker had promised to assist with "in-house claims handling services" upon procurement of the policy but had failed to assist with the claim.
