Court: WD Tx  08/17/2021  In-State Defendant Exercises "Snap Removal" and is Granted Dismissal in Federal Court

A court of the Western District of Texas found that an in-state "forum defendant," an insurance agent, could exercise snap-removal from state court before foreign defendant was served and joined in state court, and could seek dismissal for improper joinder, which the court granted on the grounds that all the claims asserted against the agent did not not satisfy the FRCP 12(b)(6) standard.
