The Fifth Circuit Court of Appeals followed Texas Supreme Court authority and held that payment of appraisal award under homeowners policy for fire damages barred insureds' breach of contract claim, but because pre-appraisal payments did not "roughly correspond" to amount of appraisal award, the case should be remanded on the amount of interest owed under Texas Insurance Code Chapter 542.
