A court of the Northern District of Texas resolved cross-motions for summary judgment between a lender and a surety insurer, holding that the lender's perfected security interest in a bankruptcy debtor's bank accounts had priority over the surety insurer's interest where the lender perfected its interest first and where the debtor had not created a trust on behalf of the surety insurer.
