Law Office of Rogelio Solis PLLC v. Curtis
Following a trucking accident resulting in the death of two people where an insured towing company's commercial liability insurer paid its policy limits to the family of one victim but nothing to the other, and the unpaid claimant commenced a involuntary bankruptcy proceeding against the towing company, the bankruptcy court held and the Fifth Circuit affirmed that under the circumstances the trustee properly alleged that that payment of the policy limits constituted a transfer of the debtor towing company's property.
