A court of the Northern District of Texas granted an insurer's motion to dismiss, finding that the beneficiary to a welfare benefit plan did not adequately plead any grounds for recovery where the plain terms of the plan showed that accidental death benefits ended upon the insured's voluntarily termination of his employment a week before his death and that administrative remedies under ERISA had not been exhausted prior to the beneficiary filing suit.
