Court: ND Tx  02/01/2024  Coverage Precluded Where Subject Property Is Not a "Residence Premises"

A court of the Northern District of Texas adopted a magistrate's recommendation to grant an insurer's motion for summary judgment in a homeowner's policy freeze damage dispute, finding that the insured's admission that she did not live at the subject insured property on the inception date of the policy negates coverage under the policy's "residence premises" endorsement.
