A court of the Southern District of Texas denied an insured's motion to remand in a UIM dispute, holding that complete diversity existed after the insured had settled with and non-suited the at-fault non-diverse defendant driver and that any technical deficiencies in the insurer's notice of removal did not deprive the court of jurisdiction.
