A court of the Southern District of Texas granted in part an insurer's motion to dismiss extra-contractual claims in a residential hail dispute, holding that claims for misrepresentation require a reliance element under Chapter 541, but that reliance is not required for the claim that an insurer failed to promptly provide a reasonable explanation for the insurer's denial under Tex. Ins. Code Sec. 541.060(a)(3).
