Court: WD Tx  05/25/2022  Court Denies in Part an Insurer's Motion for Judgment as a Matter of Law, Awarding Extra-Contractual Damages to Insured for Independent Injury

A court of the Western District of Texas granted in part an insurer's motion for judgment as a matter of law, modifying the applied pre-judgment interest to a simple interest calculation and the post-judgment interest rate to 0.09%, but denied the remainder of the insurer's motion holding that sufficient evidence was presented to the jury supporting breach of contract damages and extra-contractual damages for independent injuries arising out of insurer's bad faith.
