Allied World National Assurance Co. v. Old Republic General Insurance Corp.
The Fifth Circuit Court of Appeals, reversing summary judgment granted in favor of commercial general liability insurer, held that endorsement which added exception to employer's liability exclusion for injuries to employee caused by another employee applied and was not limited to injuries caused by "supervisory personnel," thus insurer owed duty to defend where underlying petition alleged employee was injured by co-employee.
