The Court found that the plaintiff had met the requirements for class certification of first-party or third-party claimants whose vehicles had been determined to be a total loss by the insurer and then within three days the insurer had filed an owner retained report with the state preventing the claimant from transferring title without first obtaining a salvage title for the vehicle.
