A magistrate for the Western District of Texas recommended that the court deny a bond claimant's motion for summary judgment and grant in part a surety's motion for summary judgment, finding that the claimant should take nothing in the suit where the claimant did not substantially comply with the McGregor Act's requirements when it sent notice to the wrong person at the wrong address and failed to include a sworn statement of account.
