The Court found that the reinsurer could not use the theory of direct benefits estoppel to force the insured to arbitrate under a reinsurance contract between the insurer and the reinsurer because the insured was asserting claims for tort and statutory claims against the reinsurer which were based on Texas law rather than seeking insurance payments under the reinsurance contract.
