A court of the Western District of Texas granted the insurer's motion to dismiss, finding that the insured's allegations of fraud and claims sounding in fraud could not withstand the heightened scrutiny required by Federal Rule of Civil Procedure 9(b) because they were not plead with sufficient particularity.
