Where an insurer's motion for summary judgment was based on a different policy term than that cited in the insured's suit and the insurer did not present any evidence regarding prompt payment, the court denied the insurer's motion for summary judgment on breach of contract and violation of the Prompt Payment Act, but granted it with respect to bad faith, DTPA, and unfair settlement practices because the evidence established a bona fide coverage dispute.
