A court of the Western District of Texas disagreed with the magistrate's finding that Texas Anti-Indemnity Act did not apply to the duty to defend, but agreed that indemnity agreement at issue did not violate the TAIA and the additional insured's motion for summary judgment should be granted on these grounds.
