Court: WD Tx  12/15/2022  District Court Dismisses Complaint Against Illinois Based Insurer For Lack of Personal Jurisdiction

A court of the Western District of Texas adopted a magistrate's recommendation and dismissed a Texas limited partnership's complaint against an Illinois based insurer for lack of personal jurisdiction and improper venue, holding that the alleged improper coverage denial did not arise from the defendant insurer's forum-related contacts where the commercial liability policy was negotiated and issued to the limited partnership's parent company in another state and where the alleged policy breach for failure to pay the limited partnership's costs for responding to a subpoena occurred in New Jersey, the location in which the insurer denied coverage.
