Court: 5th Cir  05/07/2024  Fifth Circuit Holds Federal District Court Had Jurisdiction to Appoint Umpire

The Fifth Circuit Court of Appeals reversed the district court holding that insurer's petition to appoint umpire in appraisal dispute over storm damages satisfied the $75,000 amount-in-controversy requirement because this is determined by the value of the actual dispute and not the parties' "contractual right to have an umpire examine the difference."
