The Court found that the Texas Windstorm Insurance Association had not met its summary judgment burden of establishing that the insured's selected appraiser had not acted improperly when he delegated his appraisal duties to a third party and that the appraisers had not acted improperly by refusing to consider certain extrinsic evidence as neither of these allegations by the insured were addressed in TWIA's summary judgment motion.
