Court: Tx Sup  02/02/2024  Texas Supreme Court Resolves Split Among Appellate Courts Regarding Recovery of Attorney's Fees Under Chapter 542A of Prompt Payment of Claims Act

The high court concluded that Section 542A.007 of the Insurance Code prohibits an award of attorney's' fees when an insurer has fully discharged its obligations under the policy by voluntarily paying the appraised amount, plus any statutory interest, in compliance with the policy's appraisal provisions.
