Ripley v. State Farm Lloyds

Court: ND Tx  04/01/2020  District Court Dismisses Homeowners' Insurance Dispute for Failure to State a Claim on which Relief Could be Granted

The court found that the insureds' claim that the insurer breached the contract by failing to pay an appraisal award in full was unsupported, and its other claims failed to meet the federal pleading standard. The court also denied the insureds leave to amend their complaint, finding that it would be futile because the proposed complaint did not add any factual support for their claims.

homeowners' insurance policy, hailstorm, appraisal award, uncovered damages, prompt payment of claims, bad faith, motion to dismiss, failure to state a claim, plausible right to relief, fraud, Rule 9(b)
