A Magistrate Judge of the Western District of Texas recommended that the Court grant an insurer's motion to dismiss an insured's fraud-related claims under the Texas Insurance Code and DTPA because the insured failed to satisfy the heightened pleadings requirements under Federal Rule of Civil Procedure 9(b).
