Court: ND Tx  01/31/2022  Court Grants in Part and Denies in Part Competing Motions for Partial Summary Judgment

A court of the Northern District of Texas held that commercial general liability insurer did not provide coverage for pollution cleanup costs because the insured failed to report the claim within 90 days as required under the claims-made and reported provision, but further held that separate policy’s anti-assignment provision was invalid under a bankruptcy court’s sale order and the Bankruptcy Code, and the policy provided coverage for clean-up costs as a matter of law.
