A magistrate of the Western District of Texas recommended the district court deny an insurer’s motion for summary judgment, finding that the case did not present a bona fide dispute where the insurer argued that a 2021 hail claim for a roof should be denied because the damage occurred in 2016, but where the insured presented uncontested evidence that the roof had been replaced in 2017.
