A Magistrate Judge of the Western District of Texas found and recommended that defendant insurer's motion to preclude attorneys' fees under Section 542A.007 of the Texas Insurance Code should be granted and fees sought by the insured precluded where defendant was entitled to statutory pre-suit notice of the claim under Texas Insurance Code Section 542A.003.
