A court of the Northern District of Texas granted an insurer's motion for summary judgment, holding that although Plaintiff presented evidence of hail damage on the alleged date of loss the Plaintiff failed to present any evidence allocating between the alleged date of loss and pre-policy damage, and further held that Plaintiff failed to present any evidence of damages under his common law fraud claim.
