A court of the Northern District of Texas denied an insured's motion to find the insurer waived appraisal, finding that the insurer's insistence that the amount in controversy exceeds $75,000 for jurisdictional purposes while maintaining the amount of covered damage at issue is $898.18 did not constitute an admission or behavior inconsistent with the insurer's right to invoke appraisal and that, in any event, the insured had invoked appraisal just before filing suit.
