The District Court for the Eastern District of Texas concluded that the amendments to the Texas Prompt Payment of Claims Act applying to claims for damage to real property by hail, wind and rainstorm precluded the insured's claim for statutory interest and attorney's fees when it was undisputed that the insurer had fully paid the appraisal award and any possible claim for interest.
