The Court found that the district court erred when it held that attorneys' fees were precluded as a matter of law when an insured brings a claim for UIM benefits in a declaratory judgment action and remanded the case to the trial court for consideration of whether an award of attorneys' fees would be equitable and just under the circumstances.
