A court of the Northern District of Texas adopted a magistrate's recommendation to grant in part and deny in part insurer's motion to dismiss, dismissing the ERISA claims for lack of constitutional and statutory standing and the breach of contract claim on preemption grounds, but held plaintiff's promissory estoppel claim is not preempted under ERISA and not subject to dismissal.
