A court of the Southern District of Texas adopted a magistrate's recommendation to grant an insurer's motion for judgment regarding long-term disability benefits under an ERISA plan, finding that the a review of the administrative record showed the claimant had properly been denied long-term disability benefits where the record showed the claimant was able to work on a part-time basis but chose not to do so.
