Court: Tx 14-Houston  08/17/2023  Court Affirms Summary Judgment For Insurer in Case Involving Purported Conflict Between Water Damage Limitation and Coverage for Freezing of Plumbing

The Court concluded that the insurer had properly applied the a limitation of liability for water damage to the claim even if the water damage resulted from freezing of pipes due to a winter storm rather than from a defect originating in the plumbing system because the insured's interpretation would require the court to read an exception into the limitation endorsement that did not exist in the policy language.
