A court of the Western District of Texas granted in part an insurer's motion for partial summary judgment regarding insured's extra-contractual claims in a homeowner's suit concerning a hail damage claim, finding that the insured's evidence and allegations presented a mere bona fide coverage dispute, but further held that the insured's claims under ยงยง 541.060(a)(4) and 542.058 regarding the promptness of the insurer's claim determination may proceed to trial.
