The Fort Worth Court of Appeals found that the insurer's immediate payment of its underinsured motorist benefits to the insured once she obtained a judgment against the underlying tortfeasor did not foreclose a bad faith claim against the insurer and, therefore, the trial court had not abused its discretion by allowing discovery to proceed on the insurer's alleged bad faith in refusing to make payment until the insured obtained the judgment.
