In re Old Republic Risk Management

Court: Tx 12-Tyler  06/12/2019  Appellate Court Finds that Trial Court Abused its Discretion in Denying Workers' Compensation Insurer's Plea to the Jurisdiction and Motion to Dismiss

The court determined that any ruling on whether the insurer's lien was fraudulent because it was based on inflated amounts or administrative costs that were not "benefits" fell within the exclusive jurisdiction of the Division of Workers' Compensation.
