Court: Tx 5-Dallas  08/25/2021  Trial Court Erred By Refusing to Abate Bad Faith Claims Arising Out of UIM Claim

The Court found that the lower court abused its discretion when it denied the insurer's motion to abate extra-contractual claims pending the determination of the insurer's liability for an uninsured motorist claim because it is well-settled law that extra-contractual claims are not ripe until the insurer's liability is determined under the contract.
