A magistrate of the Western District of Texas recommended that the district court grant an insured's motion to remand in a dispute regarding health insurance policy benefits, determining that the removing defendants did not satisfy their "heavy burden" to demonstrate there is no possibility of recovery against a non-diverse medical provider defendant.
