A Texas appellate court reversed the district court's allocation of a workers' compensation settlement, holding that where the settlement does not fully compensate the subrogee insurer, the subrogee insurer's recovery is to be calculated from the full amount of any settlement recovered from the tortfeasor, and that the Texas Labor Code caps the claimant's attorneys' fees at one-third the subrogee insurer's recovery.
