Hanover Insurance Co. v. Oryx Oilfield Holdings LLC

Court: ND Tx  12/09/2019  Surety Granted Summary Judgment on Breach of Contract Claim for Amounts Paid Under Bonds

A court of the Northern District of Texas granted summary judgment in favor of surety on breach of contract claim under bonds issued to defendants in connection with numerous construction projects, finding that indemnity language in bonds requiring defendants to indemnify surety for amounts paid on their behalf was enforceable, because they were properly issued, and were not barred by a subsequent oral agreement.
