Guzman v. Allstate Vehicle and Property Insurance Co.

Court: SD Tx  03/19/2020  District Court Denies Motion to Remand Based on Amount in Controversy in Homeowner's Dispute

The court found that the insured improperly pleaded damages less than $75,000 in violation of Texas Civil Procedure, and the insurer presented sufficient evidence to establish that the insured's claimed damages actually exceeded $75,000, and, therefore, the amount in controversy requirement for diversity jurisdiction was satisfied.
