Great American Insurance Co. of New York v. Nationwide Mutual Insurance Co.
The Court found that a provision in Uniform Condominium Act requiring an insurer for a condominium association to waive its right of subrogation against a unit owner precludes the insurer from seeking reimbursement from an insurer for a unit owner and therefore, a settlement agreement between a unit owner's insurer and the condominium's insurer was void as a matter of public policy.
