Government Personnel Mutual Life Insurance Co. v. Lincoln Factoring
The Court found that the trial court had erred when it applied Louisiana rather than Texas law to a factoring company's breach of contract/bad faith claims against a life insurer and therefore the appellate court reversed and rendered judgment for the insurer on all claims under Louisiana law and on the factoring company's claims for violation of Chapter 542 of the Texas Insurance Code and remanded for a new trial on all other substantive issues based on Texas law.
