A court of the Northern District of Texas granted an insurer's motion to preclude attorney's fees under Section 542A.007 of the Texas Insurance Code, holding that the claimant's purported notice via email did not satisfy the requirements of Section 542A.003 and that the statute of limitations did not render proper notice impracticable because limitations began to run on the date of denial, not the date of loss.
